Dodge Injector Claim Denied

I am working with an individual who has a 6.7L that started running rough at 6700 miles. The truck was taken to the dealer who after 8 days informed him that his problem had been traced to some non warranty related issues. The crankcase was overfilled by almost a quart. The fuel was contaminated by an unknown fluid. The PCM showed that it had been flashed back to a version that was prior to the version the truck left the factory with, that they believe was cause dby an aftermarket programmer. Given those reasons he owes them $2348 for teardown and diagnosis and has an engine in pieces. We have identified the oil over fill issue on several forums. The contaminated fuel issue appears to be a common reason for denying injector claims. The one item that doesn't fit is the "back-flash" of the PCM. They claim this is documentation of the use of a programmer/tuner. If anyone has information regarding this back flash claim I would appreciate the information. This gentleman is 57 years old and does not deserve the $13,000 engine bill.

I hate when they blame the fuel to. Ask for a sample and sent it to the fuel supplier let them look at test it and take that back to dodge. Also tell the fuel supplier Dodge is running down there fuel. I know ESSO around here is getting tired of truck manf blaming fuel and have threatened to sue a few times for them bashing there fuel. food for thought. Also fuel dilution is not the customers fault that would be caused by a faulty injector. Good luck man. let us know what happens.

Talk to the service manager and see if you guys can make a deal up calmly of course and if not i would be bagging up all the parts up and going else were. I would not be giving them any more money if there bending me over. I have got warrenty work done this with sucess in getting warrenty work done. It seems they are just trying to double dip sometimes. warrenty clame and customer paying.

I would have to ask for sure, but I AM 99% sure that once you update these ECM from say the AA Flash to the AB flash the is NO going back. Dodge should know this. This would take recovery and bootloader software. No gonna happen with a simple tuner. Heck I don't think it can happen with the starscan. Just doesnt fit, IMO.

Thanks for the posts. This morning it is going to an attorney. They have really crossed the line with this guy. He got home last night only to find a notice of mechanics lein from the dealer. I am sure when Chrysler finds out about the lawsuit if it goes that far they will shut it down and fix the mans truck. Keep posting about this flash back issue as I'm interested in whether it's legit or not and if they have used it against anyone else.

This definitely sounds fishy. The fact that there was a mechanics lean put on the truck before any nasty words were said or threats of legal action. Make me suspicious that they are merely trying to bully him into paying a large bill. And like Budtoh3zo said. Oil fuel contamination is not the owner responsibility. A tuner wont have an effect on oil contamination if the truck is running properly in the first place. Also in most instances. If the dealer has reflashed to truck with an updated strategy. The tuner that they claim is being used. Wont work. The tuner has to be updated with the current flash so they new flash and the tuner are compatible.

These strong arm tactic piss me off to no end. I would take the dealer to the wall on this.

The heads are off I gather. Any pics of the pistons? If the pistons are clean with NO STARING on all but 1 or 2 cylinders. Then the likely culprit is a fouled injector.

Lets just say not quite stock.

who is the dealer? talk to the owner or general manager, if they won't help rape them any way you can, overfilling the oil by one quart won't kill you but more could cause serious damage still the even funnier thing about the tuner is most downloaders only save the factory tune not modify the stocker, they upload a new tune that is in the tuner's memory

1. Over filling of the crankcase by 1qt is usually due to improper oil changes. Trucks have to drain oil for 30 to be completely drained and 1 at over full is in no way going to cause any problems.
2. What color was the fuel? Maybe he just go bad fuel happens to every one all the time most just don't know it.
3. It is possible to back flash with a star scan as long as an older file is already saved in the star scan. I find it hard to believe that they know the software that came in the truck from the factory. We will get brand new trucks in that will have older software then what we are installing for TSB's
4. What was the issue causing the running issue? was it just poor fuel? Then they need to drain the tank and put fuel in it.
