Is my mechanic liable?
Sorry if this is the wrong forum. New member and it wouldnt let me post this anywhere else. I have a 1990 international rollback with a 7.3 idi and a 5 speed spicer.
In the end of december i lost 5th gear in my truck and brought it to the closest diesel mechanic. They tore it apart and a few teeth were worn off the gear. They also inspected the clutch and told me it was like new and put in a new throwout bearing. (Very expensive bill, and was $1100 above the estimate).
I have put almost 2600 miles on the truck since then and all the sudden today i pushed in the clutch and there was a loud metal on metal scraping noise. I brought it to another shop and they told me it was definately the throwout bearing and to bring it back to the first guy and he should fix it because it must have been defective or not put in right.
I bring it back to the guy and he pulls the inspection plate and tells me the clutch pressure plate must have gone bad and took out the throwout bearing. Because the pressure plate fingers are wore,and he wants to charge another very expensive bill to replace it again. I guess my question is could the pressure plate have caused the throwout bearing to fail or did a defective throwout bearing cause the failure? It seems odd to me that i put 116000 miles on the first throwout bearing and less than 3000 miles after he replaces it it fails and takes out the clutch i was told is "like new"
