I don't think there is any "law" saying you have to keep your DPF on. It falls under the same standard as your Cat on a gasser. It is illegal for shops to remove cats, but nothing saying you can't do it yourself. Like previously mentioned, unless you have to pass a smog test, yard it off and throw a tuner/chip or what have you on to help you get some of that MPG back.
Don't throw it away though-them *****s are worth a ton of money!!
