So i got me some 40s and I was wondering if I have
to get in touch with spartan and tell them to change my program for
the new bigger tires.I had stocks before.Do they charge for changing
the program?

Yes i would probably do it and yes they will charge you for it, i think its like 200 bucks, the reason being is they have to rewrite all of your files for the tire size, it affects shift points among other things, thats why if i were you i would do it, and aslo why they have to charge you for it, its pretty much like writing you a complete new file from scratch.

so if i wait for the 310 tune to come out,I can just let them know at that time
then i wont get charged extra,on top of what the tune will cost?

I think that is correct, but i dont wanna say yes when im not 100% on that, and i think the 200 is for all your tunes, but again im not 100% sure.

I would have them change it or when you order the 310 let them know you changed sizes. I personally wouldnt want my speedo off that much.
